Stay Safe Street Tip #52

LOK, Gun Vaults, Local Events & Florida Firearms June 2003 Update

Good morning Folks. Jane and I wish you all a Happy & Safe Independence Day. The Fourth of July is one of my favorite holidays simply because of what we enjoy, and possibly take for granted, as a result of our forefathers efforts and sacrifices. There are so many cesspools in the world (Liberia, the Congo, Iraq, Afghanistan, Syria, Saudi Arabia, Ethiopia, North Korea, etc.) that we are truly blessed to live in this amazing country. However, the price of our freedom has not been free and may even become more expensive in this decade. Please remain vigilant, support our troops and their families and honor those who have paid for our freedom.  Norm & Jane

Ladies, the Fall Ladies of the Knight season will begin with our September 17, 2003 meeting. We will follow our regular schedule with sign-in, registration and refreshments from 6PM to 7PM. We will have a guest speaker from 7PM to 8PM and then let's celebrate the new season with a 9MM submachine gun shoot. Rock & Roll time again! Jane and I are open to suggestions for the speaker. Several topics that come to mind are women in law enforcement, women in the military, emergency first aid for firearm wounds, hair & skin care (sun damage), makeup tips and ? Please let us know your thoughts and if you have a speaker in mind.

One of the local events that I am going to mention includes a home burglary that resulted in the theft of a firearm by the scumbag, now an armed scumbag! You know how I feel about the security of firearms -- keep the dadgum things locked up! Florida State Statute 790.14 requires that you secure your firearms so that minors cannot have unsupervised access. In addition, one of my worst fears is to walk into my own home and find one of my firearms stuck in my face or Jane's face. Of course the flip side of the argument is that you may need a loaded firearm in a hurry. Knight Shooting Sports has on hand several excellent ready gun vaults as well as an excellent selection of full sized safes. I consider a ready gun vault to be a secure container that allows you to store a loaded handgun with the ability to rapidly access that firearm in an emergency.
The first vault is the ADG Sports Home/Office Mini Vault. This device allows for the storage of multiple handguns. The retail price is $149.99 but is on sale for $99.98. It features a cross bolt door, combination keypad, programmable combination, key override, tamper proof access, heavy gauge steel construction, foam padded interior and mounting bolts.
The second is the Mini Vault. This device allows for the storage of one handgun. The retail price is $139.95 but is on sale for $119.99. It features a "no eyes" control panel, built in lock for invalid entry attempts, 16 gauge steel housing, virtually impossible to pry open, spring loaded door, key back up access, foam padded interior and mounting bolts.

There have been a number of local crime events that I am going to review by category and look for common threads. How do we reduce our chances of becoming a victim? Learn from the mistakes of others. Actually it is pretty simple when you look at how the crimes are committed. Remember my basic assumption about criminal scumbags -- they are like cockroaches as well as being lazy opportunists.

       BURGLARIES

Home:
       1. Forced entry/early am -- occupied - resident asleep - sexual overtones
       2. Unlocked rear sliding glass door/late evening -- occupied - currency
       3. Broke glass sliding glass door/day time -- unoccupied - no loss
       4. Hidden key/bet 8AM-12PM -- unoccupied - expensive jewelry
       5. Unlocked door or window/9AM-12:45PM -- unoccupied - coins
       6. Pried off hasp on storage shed/9AM -- unoccupied - motorcycle
       7. Unsecured side entry door in garage/daytime -- unoccupied - power tools

       12. Unlocked entry point/daytime-early evening -- unoccupied - cash & jewelry
       13. Kicked in front door/early afternoon -- occupied by teenage girl - confronted with knife - jewelry

Business:
       1. Through window/non-business hours -- computer
       2. Cut hasp lock/non-business hours -- nothing taken
       3. Climbing through window/early am -- drugs
       4. Threw object through window/non-business hours -- office equipment & tools
       5. Unlocked motor home/ non-business hours -- food
       6. Kicked in front door of trailer/non-business hours - nothing taken
       7. Cut off locks/non-business hours -- coins

Not very arcane is it? Install a Protec or Guardian alarm system (Joe Pine) and use it, add Mylar Glass Gard (Tony Davis) to all your windows, upgrade all door and window locks via Best Lock & Safe (Chris Cooper), replace flimsy doors with solid core doors by Done Right Carpentry (Paul DiStefano) and don't hide keys around your home. Don't forget that I have a full security team and can help you secure your home and business. Incidentally, please be sure to contact me if you need security upgrades. I will then call the troops and see that you receive your discount as one of my students!

VEHICLE BURGLARIES

       1. Unlocked/afternoon -- home - medications
       2. Unlocked/late evening-early am -- home - battery
       3. Unlocked/late evening-early am -- home - miscellaneous
       4. Pried open trunk/afternoon -- home - speakers
       5. Doors & windows unlocked/mid-afternoon -- mall - stereo
       6. Broke passenger side window/mid-morning -- mall - purse & wallet in plain sight
       7. Unlocked/late afternoon -- parking garage - miscellaneous
       8. Broke glass/early morning -- home - audio & light package
       9. Unlocked/late evening -- home - attempted GTA
       10. Partially open window/early am -- parking lot - purse plain sight
       11. Broke vent window/early evening -- mall - computer & cash plain sight
       12. Forced door/early am -- home - attempted GTA - owner witnessed & activated audible home alarm (Great!)
       13. Hide a Key/mid-AM -- motel - expensive sports goods in plain sight
       14. Unlocked/early evening -- parking lot - purse in plain sight - identity theft
       15. Unlocked/early am -- home - miscellaneous property
       16. Unlocked/overnight -- home - CD/stereo unit

This is easy! Close your windows and lock your car every time that you park it!  Ten (62.5%) were either unlocked or had open windows. One (6.25%) had a "hidden key" -- yeah, right! Five (31.3%) had valuable or apparently valuable portable property in plain sight. Don't hide keys and don't leave valuables in plain sight -- those items say "Steal me, Please!" The smartest guy of the lot was the man that set off his audible alarm to break up the attempted GTA. Beautiful -- no muss, no fuss, no personal danger, no confrontation & very effective. Sure supports the cockroach theory of criminality!

Florida Firearms - Law, Use & Ownership June 2003 Update

Once again, hats off to Jon H. Gutmacher, author of Florida Firearms - Law, Use & Ownership, for allowing me to provide my students with another fine legal update. Jon is definitely a major asset and resource for Florida gun owners. Please note that Jon recommends that you replace any printings before October 1999.

The Florida Department of Agriculture officially took over the duties of the Division of Licensing as of 1/1/2003, from the Dept. of State. All addresses, phone numbers, and personnel remain the same with the exception that it is now the Florida Department of State, Division of Licensing.
Federal removal of disabilities not available except by Presidential pardon. U.S. v. Bean (U.S.S.Ct. 12/2002)
Convicted felon cannot handle firearm even as employee of gun dealer. U.S. v. Fleischli, 305 F3d. 643 (7th Cir. 2002)
Pawn shop's refusal to return stolen gun to rightful owner unless he paid money loaned is federal felony. 18 USC 922 (j) U.S. v. Webber, 255 F.3d 523 (8th Cir. 2001) because illegal to possess, store, sell or barter stolen firearm.
99 H.B. 1227 passed and enacted into law by Governor on 6/3/03 - automatic (switchblade) knives are once again legal. You need a Concealed Permit to have them on your person when off your property.*
a loaded firearm in center console is "securely encased". Dixon v. State, 27 FLW 25899 (4DCA 12/02)
*Commentary: The bill was passed without opposition and signed by the Governor on June 3, 2003. It corrects an incredible misinterpretation of the law by the Fourth District Court of Appeal, back in 2000, which incorrectly criminalized possession of these knives.

Please visit our website www.FloridaFirearmsLaw.com for free updates, etc.
Our phone number on some early editions was printed incorrectly. It is: 407-650-0770.
We recommend the 1997 printing of the Fourth edition be replaced as outdated, and suggest that replacement might be a good idea for any printings before October 1999.
