 Florida Firearms April 2002 Update and New Classes


Good morning Folks. I hope all are well and staying safe. Please be advised that I do have slots available for the May 11, 2002, Tactical Firing Course. This course will be conducted from 8:00AM to 12:00PM and require 250 rounds of handgun. As a deviation from the normal schedule, I will offer the Tactical Firing Course June 2, a Sunday, also from 8:00AM to 12:00PM. Space is also available for this course. Knight Shooting Sports has the range reserved for the Sig Academy and asked if I would change my class date. Absolutely  -- a free weekend! I am adding two new classes effective June and July. The first addition is Firearms Safety. This class will be open to all aged 12 and greater, will last approximately two hours and  cover basic firearm safety with emphasis on the home, children and new shooters. If you have younger children or would like private instruction, please contact me to discuss a private class. The fee will be $45.00 each and include range fees, instruction and the usage of a .22 caliber rifle and pistol. A parent or someone acting in 'loco parentis' must be present and sign the required waivers for their child or children. The first class is June 5 at 6:30PM and the next two June 16 at 9:30AM and July 7 at 9:30AM. Each student will fire 50 rounds and must purchase their own ammunition. This may be an excellent summer activity! The next new class is Family Safety. This class will be approximately 1 ½ hours in duration and without fee. The class purpose will be to begin educating children and their parents in firearm safety with particular emphasis on the child. Jane and I raised four children in a firearm owning home and believe that education is absolutely critical. We will address appropriate responses and weapon security from the perspective of protecting our children based on the National Rifle Association's Eddie Eagle program. If so desired, the class will allow the child, as well as the adult, under direct supervision to actually fire a .22 caliber rifle or handgun. Class participation certificates suitable for framing will be issued for each student in both classes. These schedules will be on the website this week. For your information Folks, Knight Shooting Sports is now offering memberships. Please contact the store directly (727-546-4447) for information. I will publish in the next week or two hopefully. par. #8 A "withheld" on a nolo plea is not a domestic violence "conviction" per current FDLE interpretation (see next note) However, if you plead "guilty" or were found guilty after a trial - federal law currently considers it a "conviction" even if you got a "withheld". This is due to an incorrect interpretation of Florida law by the federal courts which can't be corrected until the Eleventh Circuit Court of Appeals in Atlanta reverses itself on the incorrect ruling.
61-62 A person with a misdemeanor battery/assault "withheld adjudication" involving "domestic violence" should not possess firearms under current federal law if plead "guilty"; or if "found guilty" after trial. Only a "nolo" or "no contest" plea with a "withheld adjudication" is currently acceptable. Also, under Florida law (and thus federal law) can't purchase a firearm from a dealer, or obtain a concealed permit until 3 years after probation or any other portion of sentence has elapsed. F.S. 790.065(2)(a)(3).
The book incorrectly indicates that "possession" of firearms was illegal for the three year period. That's a mistake. You can possess once probation is over, but you can't purchase from a firearms dealer, or have a concealed permit for the three year period. So technically, you could purchase privately, from a non-dealer, and be legal - but not from a dealer.
